Is CBG Flower Legal? State-by-State Guide (2026)

Federal law says yes. But state laws vary, and a new federal regulation takes effect in November 2026. Here is the complete picture.

The federal answer: yes

CBG flower is federally legal in the United States under the Agriculture Improvement Act of 2018 — commonly known as the 2018 Farm Bill. The Farm Bill defined "hemp" as Cannabis sativa and its derivatives containing no more than 0.3% delta-9 THC by dry weight, and removed hemp from the federal Controlled Substances Act.

CBG flower derived from hemp meets this definition. Sober Sativas products contain less than 0.3% delta-9 THC by dry weight, as confirmed by third-party Certificate of Analysis testing on every batch. This means they are federally legal to produce, sell, and ship across state lines — with state-level exceptions noted below.

Why CBG has a compliance advantage

Among hemp-derived products, CBG flower occupies a particularly strong legal position for one reason: it is naturally ultra-low in total THC, not just delta-9 THC.

Many full-spectrum CBD products contain a range of cannabinoids including delta-8 THC, THCV, THCa, and other compounds that contribute to "total THC." CBG is biosynthetically upstream of all of these — the plant has not yet converted it into any THC variant. As a result, high-CBG flower typically has total THC levels well below the thresholds that affect other hemp products.

This becomes directly relevant in November 2026 (see section below on P.L. 119-37).

P.L. 119-37: the 2026 hemp regulation

In 2025, Congress passed P.L. 119-37, which takes effect in November 2026. The law establishes a 0.4mg total THC cap per hemp product — a significant shift from the current delta-9 percentage threshold.

The impact of this regulation on the hemp industry is significant:

  • Full-spectrum CBD products — many will not meet the 0.4mg total THC cap, particularly in higher-dose formats like tinctures and gummies. An estimated 90% of current full-spectrum CBD products may need reformulation or will become non-compliant.
  • CBG flower — structurally well-positioned. The naturally ultra-low total THC content of CBG flower means it is likely to remain compliant under the new standard. CBG is upstream of THC synthesis, not downstream.
  • Hemp industry consolidation — expect a contraction in CBD product diversity and an increase in demand for non-psychoactive cannabinoids like CBG.

While CBG flower is federally legal, individual states have the authority to enact their own hemp restrictions. A number of states have enacted restrictions on smokable hemp products specifically — treating the smoking method differently from other hemp delivery formats.

Idaho

Idaho has some of the most restrictive hemp laws in the country. The state requires hemp products to contain 0% THC (not the federal 0.3% threshold). Smokable hemp is effectively prohibited. We do not ship to Idaho.

Kansas

Kansas law restricts hemp products and does not have a clear framework for smokable hemp flower. We do not ship to Kansas out of an abundance of caution.

Nebraska

Nebraska has restrictions on hemp-derived products and smokable hemp. We do not ship to Nebraska.

North Carolina

North Carolina has specific prohibitions on smokable hemp flower. We do not ship to North Carolina.

South Carolina

South Carolina has restricted smokable hemp products. We do not ship to South Carolina.

South Dakota

South Dakota has historically had restrictive hemp regulations. We do not ship to South Dakota.

Tennessee

Tennessee has enacted specific restrictions on smokable hemp products. We do not ship to Tennessee.

Wyoming

Wyoming has restrictions on hemp-derived products. We do not ship to Wyoming.

PACT Act: why an adult signature is required

All Sober Sativas orders require adult signature confirmation upon delivery. This is a requirement under the Prevent All Cigarette Trafficking (PACT) Act, which was amended to include smokable hemp products. You must be 21 or older to receive your order.

If no one is available to sign at the time of delivery, the carrier will leave instructions for scheduling a redelivery or arranging pickup at a carrier facility.

Will CBG flower show up on a drug test?

Standard drug tests screen for THC metabolites, not CBG. However, because CBG flower contains trace amounts of delta-9 THC (less than 0.3%), there is a theoretical possibility of a positive result with heavy or frequent use.
