1. ACCEPTANCE OF TERMS

By accessing this site or placing an order, you agree to be bound by these Terms of Service and our related policies, including our Shipping & Returns Policy and Privacy Policy. If you do not agree, do not use this site or place an order.

2. ELIGIBILITY — 21+ ONLY

You must be at least 21 years of age to purchase products from Sober Sativas. By placing an order, you confirm that you meet this requirement. Sober Sativas sells smokable hemp products subject to the federal PACT Act, which requires age verification and adult signature at delivery. We reserve the right to cancel any order where we cannot confirm eligibility.

3. PRODUCT DISCLAIMER

Products sold by Sober Sativas are hemp-derived and federally legal under the 2018 Farm Bill. They are not intended for use by pregnant or nursing individuals. Consult a physician before use if you have a medical condition or take prescription medication.

4. HEMP COMPLIANCE

All products are sold in compliance with applicable federal hemp laws, including the Agriculture Improvement Act of 2018 (2018 Farm Bill). Products contain less than 0.3% delta-9 THC by dry weight. You are responsible for understanding and complying with your local and state laws before placing an order. Sober Sativas does not ship to states where hemp products are prohibited — see our Shipping Policy for the current list of restricted states.

5. PRODUCT INFORMATION, PRICING, AND AVAILABILITY

We work to keep product descriptions, pricing, and availability accurate, but do not warrant that all listings are free of error. We may correct errors, update information, or cancel orders where pricing or availability errors have occurred. Batch-to-batch variation in cannabinoid percentages is normal for agricultural products; COA results reflect the tested batch and may differ from other batches.

6. ORDER ACCEPTANCE AND CANCELLATION

Your order constitutes an offer to purchase. We reserve the right to accept, reject, limit, or cancel any order at our discretion, including for suspected fraud, legal restrictions, inability to verify age, or inventory constraints. If we cancel a paid order, we will issue a full refund to the original payment method.

7. PAYMENTS

All payments are processed securely through Authorize.Net, a PCI-compliant payment processor. Sober Sativas does not store full payment card data. By submitting your payment information, you authorize us to charge the stated amount for your order.

8. SHIPPING, RETURNS, AND REFUNDS

Shipping restrictions, delivery terms, and refund eligibility are governed by our Shipping & Returns Policy, which is incorporated by reference into these Terms.

9. INTELLECTUAL PROPERTY

All content on this site — including text, graphics, product photography, branding, logos, and layout — is owned by or licensed to Sober Sativas / Total Hemp Consumables LLC and may not be reproduced, redistributed, or used without prior written permission.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Sober Sativas and Total Hemp Consumables LLC are not liable for indirect, incidental, special, consequential, or punitive damages, or for losses resulting from product misuse, carrier delays outside our control, or unauthorized access to your account.

Nothing in these terms excludes liability that cannot lawfully be excluded under applicable consumer-protection law.

11. INDEMNIFICATION

You agree to indemnify and hold harmless Sober Sativas and Total Hemp Consumables LLC from any claims, damages, and expenses arising from your misuse of the site, violation of these Terms, or purchase of products in a jurisdiction where such purchase is restricted or prohibited.

12. GOVERNING LAW AND DISPUTES

These terms are governed by applicable U.S. federal law and the laws of the state of Michigan. Any dispute will be resolved in a court of competent jurisdiction unless otherwise required by applicable consumer-protection law.
